Terms and Conditions of Sale
Introduction / Agreement
By accepting an estimate, quotation, or sales order issued by R and M Flooring Limited, located at 4 – 120 Glacier Street, Coquitlam, BC V3K 5Z6, the customer acknowledges and agrees to be bound by the terms and conditions set forth on this page. These terms and conditions shall govern all sales, installations, and related services provided by R and M Flooring Limited unless otherwise agreed to in writing by the company.
Estimates & Acceptance

Validity: Estimates issued by R and M Flooring Limited are valid for a period of forty-five (45) days from the date of issuance, unless otherwise specified in writing. After this period, pricing and availability are subject to change.

Acceptance: An estimate shall be deemed accepted when R and M Flooring Limited receives one of the following:

Signed approval of the estimate,

Written or email confirmation,

Payment of the required deposit, or
-
An authorized purchase order (PO) specifying the approved dollar amount.

Scope of Estimate: Estimates are prepared to the best of our estimators’ ability based on the information available at the time of assessment. The estimate covers only the products and services specifically listed. Any changes, additions, or modifications requested by the customer, as well as any unforeseen issues or site conditions encountered during the project, will be treated as extra work and billed accordingly.
Payment Terms

Deposit: A deposit of seventy-five percent (75%) of the total contract value is required to initiate material ordering and secure scheduling of the project, unless a separate agreement has been made in writing. Work will not commence, nor will materials be ordered, until the deposit has been received in full.

Balance Due: The remaining twenty-five percent (25%) is due immediately upon completion of the work, unless otherwise agreed to in writing.

Accepted Payment Methods: R and M Flooring Limited accepts payment by credit card, e-transfer, or cheque.

Late Payments: Any overdue balances may be subject to interest charges and/or collection fees, applied in accordance with applicable laws of the Province of British Columbia.

Ownership of Materials: All materials supplied and installed by R and M Flooring Limited remain the sole property of the company until full payment has been received. The company reserves the right to remove or reclaim materials in the event of non-payment.
Installation Conditions

Furniture and Appliances: Unless specifically included in the estimate, the customer is solely responsible for removing and replacing all furniture and appliances prior to installation. If R and M Flooring Limited includes any manipulation of furniture or appliances in its estimate, such services will only cover the items expressly listed. By accepting any estimate that includes furniture or appliance manipulation, the customer agrees to release and indemnify R and M Flooring Limited from any and all liability for damages or claims arising from such handling.

Plumbing and Electrical: R and M Flooring Limited does not perform plumbing or electrical work, including but not limited to the disconnection or reconnection of toilets, dishwashers, stoves, or other fixtures. The customer is solely responsible for arranging and paying for any necessary plumbing or electrical work. The customer further agrees to release R and M Flooring Limited from any liability relating to plumbing or electrical connections.

Delays and Site Readiness: The customer must ensure that the site is ready and accessible for installation at the scheduled time. If the site is not ready, or if delays are caused by others, R and M Flooring Limited reserves the right to charge a trip fee of $250.00 and to reschedule the installation at its discretion.

Subfloor Conditions: Installation is contingent upon the subfloor being suitable for the type of flooring selected. If subfloor repairs, leveling, or preparation are required and not included in the original estimate, such work will be treated as an additional charge. R and M Flooring Limited will provide the customer with a separate estimate for such work, and no repairs will be performed until written approval and payment (or an authorized purchase order) have been received.
Warranty

Workmanship Warranty: R and M Flooring Limited warrants its installation workmanship for a period of one (1) year from the date of completion. During this period, any installation issues arising directly from workmanship will be corrected at no additional charge, subject to the conditions outlined below.

Manufacturer’s Warranty: All flooring products are covered exclusively by the manufacturer’s warranty. R and M Flooring Limited does not extend or modify these warranties. However, we will assist customers in submitting warranty claims to the supplier or manufacturer, provided that any remedy is contingent on receiving an approved credit or authorization from the manufacturer.

Inspection Period: Upon completion of the work, the customer has forty-eight (48) hours to inspect the installation and notify R and M Flooring Limited of any deficiencies or damages. If no notification is received within this period, the work shall be deemed accepted as complete and free of deficiencies. Any issues reported after the 48-hour period may incur charges for correction or repair. Reports of damage to walls, furniture, or other items must also be made within 48 hours; otherwise, R and M Flooring Limited will not accept liability.

Exclusions: The following are not covered under any warranty provided by R and M Flooring Limited:

Normal wear and tear, including scratches, dents, or fading;

Damage caused by misuse, abuse, accidents, or negligence;

Water damage, flooding, or excessive moisture;
-
Damage caused by lack of proper maintenance or use of inappropriate cleaning methods;
-
Issues arising from improper humidity or environmental conditions;
-
Damage resulting from moving heavy furniture or appliances without adequate protection.

Warranty Claims – Workmanship: Warranty coverage for workmanship is limited strictly to the scope of work performed by R and M Flooring Limited as set out in the original sale. R and M Flooring Limited shall not be liable or responsible for any incidental or consequential expenses, including but not limited to: moving or packing furniture, loss of income, loss of use or access to the affected space, or any plumbing or electrical disconnections/reconnections.

Warranty Claims – Manufacturer: In the case of a manufacturer’s warranty claim, R and M Flooring Limited will only proceed once an approved credit or authorization has been received from the manufacturer. Any corrective work performed by R and M Flooring Limited will be limited to the original scope of work and subject to the same exclusions and limitations as outlined above. R and M Flooring Limited shall not be liable or responsible for any incidental or consequential expenses, including but not limited to: moving or packing furniture, loss of income, loss of use or access to the affected space, or any plumbing or electrical disconnections/reconnections.

Warranty Claim Process: Customers must notify R and M Flooring Limited of any warranty concern by phone or email (email is strongly recommended for record-keeping purposes). Customers must allow reasonable access for inspection of the reported issue. Remedies under this warranty shall be limited to repair or replacement of the affected area, at the sole discretion of R and M Flooring Limited.
Returns & Cancellations

Deposits: All deposits are non-refundable. However, at the sole discretion of R and M Flooring Limited, if materials have not yet been ordered, a partial or full refund of the deposit may be granted.

Special Orders: Any special order materials are 100% non-refundable under all circumstances.

Quantity-Based Pricing: Any special pricing provided based on quantity purchases is subject to a no-return policy. No returns will be accepted for materials sold under such terms.

Restocking Fees: For cancellations or returns approved by R and M Flooring Limited, a 25% restocking fee will apply in addition to any supplier charges. Returns are only permitted if approved in writing by R and M Flooring Limited.

Cancellations After Ordering: Once materials have been ordered, cancellations will not be accepted. If the contract includes installation services, the customer may cancel the installation portion only, but remains fully responsible for the cost of all materials ordered and must arrange for prompt pickup of such materials.
Limitation of Liability

Scope of Responsibility: R and M Flooring Limited’s liability is strictly limited to the products and services it directly provides under the original sale contract.

Exclusion of Damages: In no event shall R and M Flooring Limited be held liable for any indirect, incidental, or consequential damages, including but not limited to: loss of income, loss of use of the premises, inconvenience, delays, costs of alternative accommodations, or any expenses associated with moving, packing, or storage of furniture or personal belongings.

Liability Cap: The maximum liability of R and M Flooring Limited for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the customer under the contract giving rise to the claim.

Customer’s Responsibility: Customers are responsible for ensuring the protection of all furniture, valuables, wall finishes, and surrounding areas not included in the scope of work. R and M Flooring Limited shall not be responsible for damages to such items unless expressly included in the contract.

Third-Party Services: R and M Flooring Limited is not responsible for any work performed by third parties, including but not limited to plumbing, electrical, or other trades. Any issues or claims arising from such services are the sole responsibility of the customer and the third-party provider.
Governing Law, Entire Agreement & Contact Information

Governing Law: These Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of British Columbia.

Entire Agreement: These Terms and Conditions, together with any written estimate or sales agreement issued by R and M Flooring Limited, constitute the entire agreement between the parties. They supersede all prior or contemporaneous discussions, representations, or verbal promises not expressly included in writing. No amendment or modification shall be valid unless made in writing and signed by both parties.
